My colleague, Gwynne Monahan, captures some important insights in this thoughtful piece about the interplay between convenience and privacy in our social networking lives. Let us know what you think: are we too willing to give away a fundamental right to make our lives easier?

I must confess that I have started, and summarily discarded, a number of drafts of this guest post on privacy. It is a complicated issue, to be sure, and…

Depending on where you work, profanity is a fact of life. What might not be common in an office may be normal in a lumber yard, trucking company or merchant ship. We have all heard the expression "swears like a drunken sailor." The 11th Circuit Court of Appeals, however, ruled that workplace profanity alone may constitute illegal sexual harassment.
Last week the 11th Circuit released an…

As social networking sites proliferate, discussions have begun regarding the value of such sites and whether their value is increased or diminished by being "closed" (membership and login required) or "open" (anyone can join in at any time). One very lively conversation is taking place at Martindale-Hubbell Connected (Social Media Policy Group) in response to a blog post entitled "Competing Interest of Open v Closed Networks." (registration required) In one of the comments, Mike Mintz of…

Tax Liens? You can still salvage your credit standing but you need to know how.
In today's economy, keeping a good credit score is more important than ever. A bad credit score can mean no car loan or mortgage or paying much higher rates. Tax liens can ruin your score. Even if you eventually pay the tax, the line filing remains as a black mark on your credit score. There is another way however.
The IRS does have a procedure to "withdraw" filed tax…

So I'll start with me: I've never been a goal-setter. I've never had a vision of where I want to be 6 months from now, let alone 5 years. My mom loved to tell everyone what an easy baby I was, because she'd sit me in the middle of the floor and surround me with toys. One by one, the toys would roll away, and I would never go after them. When finally there were no more toys, I'd just sit there perfectly content with absolutely nothing to do. I just didn't have the proactive gene.
Why…

Hardly a week goes by without seeing a newsletter or advertisement promoting the benefits of offshore accounts. If done for the right reasons, both offshore investments and offshore accounts make sense. (Remember, there is a difference.) Certainly, these types of investments can provide…

By and large, the legal industry has not been comprised of a revolutionary crowd. This should not come as a surprise, if you were listening in whatever law school class discussed the fact that our profession was born of the King's desire to delude his serfs into believing their grievances would be heard by an impartial tribunal. The King appointed his lawyers to represent their claims. The fact that they always lost was somehow ameliorated by the fact that they had been heard. Kings were…

One of the primary advantages of incorporating your business, large or small, is to protect your personal assets from business liabilities. When you form a corporation, limited liability company, or similar business entity, a “corporate veil” is created between your personal assets and your business. What most people either don’t know or don’t take seriously, however, is that you must do more than simply form the corporate entity and register it with the state. The entity must be properly…
